In September 2025, Tom Dukes and Zack Trapp obtained a voluntary dismissal with prejudice for our client after three years of litigation in Marion County, FL. Plaintiff alleged our client, a hospitalist and primary care physician, was negligent for failing stop an antiplatelet medication prior to the patient undergoing a liver biopsy for potential lung cancer, which resulted in a bleed and ultimate death of the patient. We were able to show through discovery that our client consulted the appropriate specialists, including hematology, interventional radiology and pulmonology, who were the decision-makers in regards to performing the biopsy. We were also able to prove through expert discovery that the patient required the biopsy regardless of the medication he was on, and that more likely than not the patient would have suffered a bleed regardless. As a result, Plaintiff dismissed all claims against our client and dropped him from the lawsuit.
