On December 16, 2025, Tom Dukes and Zack Trapp obtained a defense verdict in Orange County on behalf of a OBGYN in a hard-fought 7-day trial. Plaintiff claimed that our doctor failed to provide sufficient informed consent prior to performing a myomectomy to remove a large fibroid on the uterus, and that our doctor did not explain a hysterectomy was a possible complication of the procedure. This was the third procedure our doctor performed on Plaintiff over the years, with each carrying a risk of hysterectomy. During the subject surgery, our doctor had to use her intraoperative judgment to do what she felt medically safest for the patient and converted the procedure to a hysterectomy because the uterus could not be re-approximated. The jury deliberated for less than three hours and retuned a complete defense verdict.
