Tom Dukes and Dhillon Ramkhelawan obtained a final dismissal with prejudice for a Celebration Hospitalist in a wrongful death case in Osceola County on March 5, 2026. The case concerned allegations our client failed to alert the on-call neurologist about the decedents alleged change in neurological condition within the effective time-period for Tissue plasminogen activator (“tPA”) for a potential stroke. The case was defended with expert support from hospital medicine and neurology perspectives for our client. Moreover, through discovery, the testimony from the decedents treating tele-neurologist in the emergency department, and nursing and physical therapy teams at the hospital, made it clear there were no significant neurological changes reported to our client that would have warranted her to contact the on-call neurologist to administer tPA. Plaintiff dismissed the case against our client with prejudice after we made them aware of these key facts.
