Ralph Martinez and Dhillon Ramkhelawan successfully argued a Motion to Dismiss for an Orlando podiatrist on January 30, 2025. The claims against our client were that he was vicariously liable for another podiatrist at his practice who Plaintiff alleged improperly scraped a callus on the bottom of his right foot resulting in an osteomyelitis infection and subsequent below the knee amputation. We argued that the case should be dismissed because Plaintiff did not go the mandatory presuit process in medical malpractice actions and that he did not properly plead a claim of vicariously liability against our client. The Judge agreed with our arguments and dismissed the case against our client.
