On May 23, 2025, Dhillon Ramkhelawan and Mary Jaye Hall obtained final summary judgment for Publix Supermarkets in Orange County. The lawsuit stemmed from an incident where the Plaintiff tripped and fell off his electric Segway scooter after it impacted the apron that abutted Publix’s parking lot and the roadway owned by the municipality. The Plaintiff alleged both Publix and the municipality negligently maintained the apron, causing his fall. We made the following arguments: (1) the apron did not pose a dangerous condition; (2) Publix did not have actual or constructive notice of a dangerous condition; (3) the condition of the apron was open and obvious; and (4) the municipality could not delegate its duty to maintain the apron to Publix as the abutting private property owner. The judge agreed with our arguments and dismissed the case against Publix with prejudice
