On June 6, 2025, Dhillon Ramkhelawan and Mary Jaye Hall obtained final summary judgment for Publix Supermarkets in Brevard County. The lawsuit involved a slip and fall accident where the Plaintiff slipped and fell on a puddle of milk that was unknowingly spilled by another customer three minutes before the incident. Plaintiff alleged Publix violated both its own policies and procedures and its legal duty of care as it relates to cleaning up foreign transitory substances and providing a safe environment for its patrons. We argued the available record evidence proved that Publix did in fact comply with its policies and procedures and that the case law in Florida is clear three minutes is insufficient to establish actual or constructive to impute a claim of negligence against Publix based on a theory of premises liability. The judge agreed with our arguments and dismissed the case against Publix with prejudice.
