Mary Jaye Hall, Tom Dukes and Kelsey Weiss obtained a defense verdict on July 26, 2024 for a Miami based OB/GYN. The case involved delivery of a newborn with a shoulder dystocia injury. Plaintiffs claimed our client used excessive force in delivering the baby resulting in permanent injury to the nerves of her brachial plexus. However, our team presented the jury with a clear mechanism of injury – the maternal forces of labor. Through the testimony of our client, fact witnesses, experts in the fields of Obstetrics and Pediatric Orthopedic Surgery, and strategic cross-examination of Plaintiffs’ experts, the jury heard science-based evidence demonstrating the maneuvers employed by our client were efficient, appropriate, and ultimately saved this child’s life. We also used causation and damages experts, in addition to a skillful cross-examination of the child’s mother by Mary Jaye Hall, to explain why the life care plan and damage estimates presented by the Plaintiffs was not appropriate, casting doubt on the remainder of their arguments. After a two-week trial the jury concluded there was no negligence on the part of our client.
