In December 2024, Tom Dukes and Zack Trapp obtained a dismissal with prejudice for a hospitalist in Osceola, FL after lengthy litigation in a wrongful death action. The allegations dealt with whether it was appropriate to start the patient on Lovenox, an anticoagulant, when the patient had a reported history of fall but no active symptoms in the emergency department. We were successful in convincing Plaintiff to dismiss our client with prejudice given our client’s peripheral involvement and appropriate decision to admit the patient for higher level of care.
