Dhillon Ramkhelawan and Mary Jaye Hall obtained final summary judgment for Publix Supermarkets in Ocala

On September 15, 2025, Dhillon Ramkhelawan and Mary Jaye Hall obtained final summary judgment for Publix Supermarkets in Ocala. The case involved an incident where the Plaintiff slipped and fell on a few droplets of water in the self-checkout area after he had already walk past the self-checkout associate. Plaintiff alleged the source of the droplets of water was from a previously unidentified customer who purchased flowers from the flower section located on the opposite end of the store and then unknowingly tilted the flowers in the self-checkout area approximately 44 seconds before Plaintiff slipped and fall. We made the following arguments: (1) Publix appropriately had wet floor mats, flower bags and warnings in the flower section advising customers to bag the flowers; (2) the available record evidence proved there were no prior incidents of water being dropped from flowers in the self-checkout area; and (3) 44 seconds is insufficient to establish actual or constructive notice under Florida law. The judge agreed with our arguments and dismissed the case against Publix with prejudice.
