Dhillon Ramkhelawan and Mary Jaye Hall obtained final summary judgment for Publix Supermarkets in Daytona Beach

On August 18, 2025, Dhillon Ramkhelawan and Mary Jaye Hall obtained final summary judgment for Publix Supermarkets in Daytona Beach. The case stemmed from a trip and fall incident where Plaintiff tripped and fell on a rainy day precaution rug at the front of the store. Plaintiff claimed the rug slipped from underneath him causing him to trip and that there were no warning signs indicating any reason to be cautious. We argued that the rainy day precaution rug did not constitute a dangerous condition which in turn meant Publix did not have actual or constructive notice of any alleged dangerous condition related to the rug. We also argued the available record of evidence of the deposition testimony and the CCTV footage of the incident clearly showed there were two yellow wet floor caution cones on each side of the rug and that Plaintiff simply tripped and fell on his own slippers. The judge agreed with our arguments and dismissed the case against Publix with prejudice.
