Zack Trapp and Dhillon Ramkhelawan obtained final summary judgment for Publix Supermarkets in Orange County

On August 12, 2025, Zack Trapp and Dhillon Ramkhelawan obtained final summary judgment for Publix Supermarkets in Orange County. The lawsuit involved an alleged trip and fall incident where the Plaintiff claimed he tripped and fell on a yellow wet floor sign in the restroom stall at a Publix distribution center. We argued Publix did not have actual or constructive notice of the alleged yellow wet floor sign and that it would be the impermissible stacking of inferences to infer that it was put there by a Publix employee. We also argued the available record evidence of the deposition testimony and photographs contradicted Plaintiff’s version of the events and instead proved that Publix maintained the restroom in the distribution center in a reasonably safe and clean manner. The judge agreed with our arguments and dismissed the case against Publix with prejudice.
