Tom Dukes and Dhillon Ramkhelawan Obtained a Final Order of Dismissal For a Gastroenterologist and a Nurse Practitioner

Tom Dukes and Dhillon Ramkhelawan obtained a final order of dismissal for a Lake County gastroenterologist and a nurse practitioner on January 17, 2025. The claims against our clients were that they failed to obtain cardiac clearance prior to a planned EGD-colonoscopy which resulted in the patient’s cardiac arrest and subsequent death. The case was vigorously defended with strong GI, cardiology, anesthesiology and pulmonology expert support agreeing that it was latent COVID-19 that caused the patient’s death and not any negligence on the part of our clients. Plaintiff filed a voluntary dismissal with prejudice after we filed our Motion for Summary Judgement on the Florida and federal COVID immunity statutes that would have increased Plaintiff’s burden at trial from ordinary negligence to reckless disregard.
