On October 8, 2024, Ralph Martinez and Dhillon Ramkhelawan successfully argued a motion to dismiss in a medical malpractice action for a dentist in Volusia County. Plaintiff alleged improper care related to the placement of an Invisalign product and tried to circumvent the mandatory presuit process by contending the claim against our client was only for negligent supervision over a dental hygienist. We argued that the care related to the Invisalign product was for the provision of medical services, which meant it was within the purview of Florida’s Medical Malpractice Act and that the case should be dismissed for Plaintiff’s failure to conduct presuit. The Court agreed with our arguments and dismissed the case against our client.
